Mark Lienhoop obtains defense verdict for Honker’s Restaurant


On July 14, 2016, NLKJ Partner, Mark Lienhoop, won a jury verdict for Honker’s Restaurant in South Bend, Indiana in the matter of Kiskowski v. Honkers II, Inc., Case. No. 71C01-1308-CT-153.  The trial in St. Joseph Circuit Court lasted three days.

The Plaintiff alleged salmonella food poisoning from eating eggs at Honkers Restaurant in 2012.  The Plaintiff had medical bills of over $49,000 and alleged permanent injuries from the salmonella.  The main dispute was if the salmonella came from the Honker’s eggs.  Plaintiff’s doctors said it was from the eggs.  Honkers presented testimony from a Purdue University food science expert that it was not possible to know if the salmonella was from the eggs.

The Plaintiff’s lawyer asked the jury to award his client $375,000.00.  The jury was out for three hours before entering a verdict in favor of Honker’s Restaurant.
